Terms of Service

1. Agreement to Terms

By installing or using BundleBoom ("Service", "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Service.

BundleBoom is operated by BundleBoom ("we", "us", or "our") and is provided as a Shopify app to help merchants create and manage product bundles.

2. Description of Service

BundleBoom provides:

• Product bundle creation and management tools
• Automated inventory synchronization
• Shopify storefront widget for displaying bundles
• Discount and pricing automation
• Analytics and earnings tracking

The Service integrates with your Shopify store using Shopify's APIs and requires appropriate permissions to function.

3. Account and Access

3.1 Shopify Account Required: You must have an active Shopify store to use BundleBoom. You are responsible for maintaining the security of your Shopify account.

3.2 Authorized Use: You must be authorized to install apps on the Shopify store. You agree to use the Service only for lawful purposes and in accordance with these Terms.

3.3 API Permissions: By installing BundleBoom, you grant us permission to:

• Read and write product information
• Read inventory levels
• Create and manage ScriptTags and App Blocks
• Create webhooks

4. Pricing and Payment

4.1 Free Plan: BundleBoom offers a free plan allowing one (1) active bundle. Additional features require a paid subscription.

4.2 Paid Plans: Pricing is displayed in the app and on our website. Paid plans are billed through Lemon Squeezy, our payment processor.

4.3 Founding Member Lifetime Deal: Limited to 100 spots, one-time payment of $290 USD. This offer grants lifetime access to Pro features with no recurring fees. Founding Member terms are non-refundable after 14 days.

4.4 Billing: Subscriptions are billed monthly or annually in advance. You authorize us to charge your payment method on file.

4.5 Refunds: Monthly subscriptions may be canceled at any time. Refunds are provided on a case-by-case basis within 14 days of purchase. Contact support for refund requests.

4.6 Price Changes: We reserve the right to modify pricing with 30 days' notice. Existing subscribers will be grandfathered at their current rate for the billing cycle.

5. Your Responsibilities

You agree to:

• Comply with all applicable laws and Shopify's Terms of Service
• Not use the Service for fraudulent or illegal purposes
• Not attempt to reverse engineer, decompile, or access the Service's source code
• Not use the Service in any way that could damage, disable, or impair our infrastructure
• Not resell or redistribute the Service without authorization
• Ensure bundle pricing and discounts comply with your local laws and regulations

6. Service Availability and Modifications

6.1 Uptime: We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

6.2 Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service with or without notice. We will provide reasonable notice for material changes.

6.3 Beta Features: Some features may be designated as "beta" or "experimental." These features are provided as-is and may be modified or removed at any time.

7. Intellectual Property

7.1 Our Rights: BundleBoom, including all software, designs, text, graphics, and trademarks, is owned by us and protected by copyright and intellectual property laws.

7.2 Your Content: You retain all rights to your store's products, images, and content. By using the Service, you grant us a limited license to use your content solely to provide the Service.

7.3 Feedback: Any feedback, suggestions, or ideas you provide become our property and may be used without compensation or attribution.

8. Disclaimers and Limitations of Liability

8.1 AS-IS Service: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Guarantee of Results: We do not guarantee that using BundleBoom will increase sales, revenue, or profits. Business results depend on many factors outside our control.

8.3 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.

8.4 Liability Cap: Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party rights, including intellectual property rights.

10. Termination

10.1 Your Right to Terminate: You may terminate your account at any time by uninstalling BundleBoom from your Shopify store. Upon uninstallation, we will delete your data as described in our Privacy Policy.

10.2 Our Right to Terminate: We reserve the right to suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion.

10.3 Effect of Termination: Upon termination, your right to use the Service ceases immediately. Bundles created by BundleBoom may remain in your Shopify store as products but will no longer be managed by the app.

11. Dispute Resolution

11.1 Informal Resolution: If you have a dispute, please contact us at support@bundleboom.app. We will attempt to resolve disputes informally within 30 days.

11.2 Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

11.3 Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class-action lawsuits or class-wide arbitration.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in Delaware.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the app. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
